bluepad — Terms of Use (End User License Agreement)

These Terms of Use (“Terms”, “EULA”) form a binding agreement between you (“you”, “user”) and Eric Detoc (“we”, “us”) regarding your use of the bluepad iOS and Apple Watch app (“bluepad”, “the app”).

By downloading, installing, or using bluepad, you agree to these Terms. If you do not agree, do not install or use the app.


1. License grant

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use bluepad on any Apple-branded device that you own or control, subject to the Usage Rules of the Apple Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/).

This license does not allow you to use bluepad on any device that you do not own or control, and you may not distribute or make the app available over a network where it could be used by multiple devices at the same time.

3. In-app purchases and refunds

bluepad offers a one-time, non-consumable in-app purchase (“Unlock”) that removes the trial restrictions and unlocks the full feature set.


4. Trial

bluepad includes a free trial period before the in-app purchase is required. The trial starts at first launch and lasts for a fixed number of days as indicated inside the app. Resetting the device clock does not extend the trial.


5. Health and safety disclaimer

bluepad is provided for general fitness, training, and informational purposes only. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and must not be relied upon for any medical decision.

Paddle sports involve inherent risk of injury, exposure, and drowning.

We are not responsible for any injury, loss, or damage resulting from your use of bluepad or from any activity undertaken while or after using the app.


6. Health data (HealthKit)

If you grant bluepad permission to read or write data through Apple HealthKit, that data is processed locally on your device as described in our Privacy Policy. You may revoke these permissions at any time from the Apple Health app.


7. Intellectual property

bluepad and all associated trademarks, logos, designs, source code, and content are owned by us or our licensors and are protected by intellectual property laws. Except for the license granted in section 1, no rights are transferred to you.


8. No warranty

To the maximum extent permitted by applicable law, bluepad is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.


9. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the app.

Our total cumulative liability arising out of or in connection with the app shall not exceed the amount you paid for the in-app Unlock during the twelve (12) months preceding the event giving rise to the liability, or, if you have not made any purchase, ten euros (€10).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (including, in the European Union, liability for gross negligence, willful misconduct, or death or personal injury caused by negligence).

You may not use or otherwise export or re-export bluepad except as authorized by United States law and the laws of the jurisdiction in which the app was obtained. You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.


12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the latest revision. If we make material changes, we will notify you through an in-app notice or release notes. Your continued use of the app after the changes take effect constitutes your acceptance of the revised Terms.


13. Governing law and jurisdiction

These Terms are governed by the laws of France, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be brought before the competent courts of France, unless a mandatory law grants you the right to bring the dispute before another court.

Nothing in this section affects any mandatory consumer rights you may have under the laws of your country of residence.
